Commissions Terms of Service

Last updated: 7/23/22

I. General

  1. By ordering a commission from me (the artist), you (the client) agree to these terms.

  2. I reserve the right to decline a commission order without reason or explanation.

  3. I have the right to alter my terms of service at any time. New terms will not apply retroactively to accepted orders.

II. Reservations and Ordering

  1. Prices listed on the Commissions page are base prices. Any modifications to mediums used will incur additional fees.

  2. Quoted prices are valid up to 1 month unless otherwise stated in writing.

  3. I accept reservations and will schedule accordingly. A reservation is only considered finalized if the deposit is paid in full upon the time of scheduling.

  4. In general, commissions are on a first-come, first-serve basis, based on who pays their deposit first. A commission request is not considered final until the deposit has been received.

  5. Any photographs provided by the client to be used as a reference photo must be taken by the client, or have the rights to allow usage of the photo. I will not accept any copyrighted artwork or any copyrighted photographs as reference photos.

  6. Any special request MUST be mentioned before the commission has started subject to exceptions and additional fees.

III. Payments and Refunds

  1. All payments must be made via Venmo to the account provided. All prices are listed in US dollars.

  2. I require at least 50% deposit to be paid before the commission is started. For article clothing’s, the item to be customized will be paid for and delivered to the provided address by the client, and this will count as the deposit. The remainder of the payment must be paid upon completion and before it is shipped. Failure to pay will result in the cancellation of the commission.

  3. Shipping costs are not included in the base price of the commissions and vary depending on the object or size of canvas. Please contact me for an estimated quote.

  4. All payments should be fulfilled upfront with the exception of payment plan options.

  5. Full refunds are issued only before the start of a work on particular order. If the client has shipped a particular item for customization then the client will also be responsible for return shipping costs. Any transaction fees will not be refunded. Refunds will not be processed if painting has started.

IV. Turnaround Times, Revisions, Deadlines

  1. The typical turnaround to complete a commission depends on many factors, including my schedule, how many commissions are in the queue, and the size and complexity of the piece. A more accurate timeline can be provided at the time of the deposit.

  2. Any deadline must be communicated and agreed upon before the initial quote.

  3. I typically will provide works in progress via email.

  4. Revisions are limited to minor adjustments such as correcting small misinterpretations. Any major adjustments will incur additional fees at my discretion. An example of a major revision would be adjusting the layout or adding more components once painting has already started.  Color and composition will be discussed before painting has began.

V. Image Rights

  1. I, as the artists, retain all copyrights to created artwork. I reserve the right to repost, use, and sell created art in digital or physical forms. Use of artwork by me, the artist, includes but is not limited to: posting in my website and portfolio, posting to social media accounts, use in advertisements, and selling as prints and merchandise.

  2. Clients may post low resolution art on their social media accounts as long as credit is given to me, and no profit is being made.

  3. Clients do not have the right to sell reproductions of the artwork in digital or physical forms, online or offline. The artist retains full copyright of the work.

  4. The exception is work for hire, which includes but is not limited to: label/logo designs, book covers, and other commercial use creations. The prices and terms for these types of commissions can be discussed via email and will entail a separate contract.

VI. Privacy

  1. Client privacy is respected. It is the intent of the artist and this website to not share client information anywhere online or offline.
